1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of VoIP services provided by Converge Telecoms LLC ("Company," "we," "us," or "our"), a Florida limited liability company located in Tampa, Florida. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.

2. Service Description

Important Notice: Our VoIP service is not a traditional telecommunications service. This service is an internet-based communication solution that converts voice into digital data packets transmitted over the internet.

We provide Voice over Internet Protocol (VoIP) services including but not limited to:

  • Voice calling services
  • Call forwarding and routing
  • Voicemail services
  • Conference calling
  • Call recording (where legally permitted)
  • Auto attendant and call queuing
  • Software-based phone applications

3. Regulatory Disclosures

IMPORTANT REGULATORY NOTICE

  • Not Traditional Telecommunications: Our service is not regulated as traditional telecommunications and may not have the same consumer protections.
  • Emergency Services Limitations: VoIP services may have limited or different emergency calling capabilities compared to traditional phone service.
  • Power Dependency: Our service requires internet connectivity and electrical power to function.
  • Service Quality: Call quality depends on your internet connection and may vary.

4. Emergency Services (E911)

CRITICAL EMERGENCY SERVICES INFORMATION

  • Emergency calling through our VoIP service may not function the same as traditional 911 service
  • You must provide accurate address information for emergency services
  • Emergency services may not be available during power outages or internet disruptions
  • It is your responsibility to inform relevant persons of these limitations
  • We recommend maintaining alternative communication methods for emergencies

5. Customer Obligations

You agree to:

  • Provide accurate account and billing information
  • Use services in compliance with all applicable laws
  • Not use services for illegal activities, spam, or harassment
  • Maintain adequate internet connectivity and compatible equipment
  • Pay all charges when due
  • Protect your account credentials and notify us of unauthorized use
  • Comply with number porting and regulatory requirements

6. Service Availability and Quality

While we strive for high service availability, VoIP services depend on factors beyond our control including your internet service provider, network conditions, and equipment functionality. We do not guarantee uninterrupted service or specific call quality levels.

Service may be temporarily unavailable for maintenance, upgrades, or due to circumstances beyond our reasonable control.

7. Privacy and CPNI Protection

We are committed to protecting your Customer Proprietary Network Information (CPNI) and personal data in accordance with federal regulations including FCC privacy rules. We will not use, disclose, or permit access to your CPNI without your consent except as required by law or for providing services to you.

8. Billing and Payment

  • Payment Terms: Payment is due according to your billing cycle
  • Late Fees: Late payments may incur additional charges
  • Service Suspension: Services may be suspended for non-payment after notice
  • Taxes and Fees: You are responsible for applicable taxes and regulatory fees
  • Disputes: Billing disputes must be reported within 60 days of the billing date

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIMS RELATED TO OUR SERVICES IS LIMITED TO THE AMOUNT YOU PAID FOR SERVICES IN THE MONTH PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

We specifically disclaim liability for service interruptions, emergency calling limitations, or damages resulting from your internet service or equipment.

10. Termination

Either party may terminate service with appropriate notice as specified in your service agreement. We may immediately terminate or suspend service for non-payment, breach of terms, or illegal use.

Upon termination, you remain responsible for all accrued charges and must return any equipment provided by us.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hillsborough County, Florida.

12. Changes to Terms

We may update these Terms periodically. Material changes will be communicated through email or service notifications at least 30 days before taking effect. Continued use of services after changes constitutes acceptance.
